Rubbish Collection Harrow Terms and Conditions
These Terms and Conditions set out the basis on which we provide rubbish and waste collection services in Harrow and surrounding areas. By booking a collection or using any of our waste management services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any rubbish, junk, waste, recycling, clearance, or related collection service provided by us.
1.2 Customer or you means the person, business, or organisation requesting or receiving the Service.
1.3 Premises means the property, site, or location where the Service is to be carried out.
1.4 Waste means any rubbish, junk, materials, items, goods, or substances presented for removal as part of the Service, excluding any prohibited or hazardous materials.
1.5 Contract means the agreement between you and us for the provision of the Service, comprising these Terms and Conditions and the details of your booking.
2. Scope of Service
2.1 We provide waste and rubbish collection services for domestic and commercial customers in Harrow and nearby areas. The specific scope of the Service will be confirmed at the time of booking and may include one-off collections, scheduled collections, bulky waste removal, or site clearances.
2.2 We reserve the right to refuse any Service or to decline to remove specific items if, in our reasonable opinion, it would be unsafe, unlawful, or impractical to do so.
2.3 We will carry out the Service with reasonable care and skill and in accordance with applicable waste management regulations and industry standards.
3. Booking Process
3.1 Bookings may be made by telephone, email, online form, or any other method we make available from time to time.
3.2 When making a booking, you must provide accurate and complete information, including:
a) Your full name, contact details, and the address of the Premises.
b) A description of the Waste to be collected, including type, approximate volume, and any special handling requirements.
c) Access details for the Premises, including any parking restrictions or limitations.
3.3 Your booking is an offer to purchase the Service. A Contract is formed only when we confirm acceptance of your booking and provide a scheduled date and approximate time slot for the Service.
3.4 We may request photographs or further details of the Waste prior to confirming your booking to help estimate the volume, weight, and nature of the materials to be collected.
3.5 Any quotation provided before we inspect the Waste is an estimate only. Final pricing will be confirmed on site once we have assessed the actual Waste and access conditions.
4. Access and Customer Responsibilities
4.1 You are responsible for providing safe, reasonable, and timely access to the Premises on the agreed date and time.
4.2 You must ensure that:
a) All Waste to be removed is clearly identified and separated from items that are not to be removed.
b) There are no health and safety risks that have not been disclosed to us in advance, such as asbestos, sharps, biohazards, or structurally unsafe areas.
c) Any required permissions, permits, or consents (such as landlord permissions, building management approvals, or council parking dispensations) are obtained before the Service begins.
4.3 If we are unable to access the Premises or safely carry out the Service due to circumstances within your control, we may charge a call-out, waiting time, or cancellation fee in accordance with section 7.
5. Waste Types and Regulations
5.1 We operate in compliance with applicable UK waste regulations, including duty of care obligations under environmental legislation. We will transport and dispose of Waste at licensed facilities where required.
5.2 The following materials are generally prohibited from our standard Service unless explicitly agreed in writing in advance and subject to separate charges and conditions:
a) Hazardous or special waste, including but not limited to asbestos, chemicals, solvents, oils, paints, batteries, gas cylinders, medical waste, or clinical waste.
b) Explosives, pressurised containers, and flammable materials.
c) Liquid waste, including tanks, drums, and containers with free-flowing liquids.
5.3 You are responsible for declaring any potentially hazardous or regulated materials at the time of booking. Failure to disclose such items may result in additional charges, refusal of Service, or termination of the Contract.
5.4 Title to and responsibility for the Waste transfers to us once it has been loaded onto our vehicle, except where any prohibited or incorrectly described materials are discovered, in which case we may return such items to you or require you to arrange suitable disposal at your own cost.
6. Pricing and Payments
6.1 Prices for our rubbish collection services may be based on factors such as volume, weight, labour time, type of Waste, access difficulties, and disposal charges.
6.2 Unless otherwise stated, all prices are quoted exclusive of any applicable taxes or government levies. If such charges apply, they will be added at the prevailing rate.
6.3 We may provide an estimated price range at the time of booking based on the information you supply. The final price is confirmed on site once we have inspected the Waste and access conditions.
6.4 We reserve the right to revise the quoted price if:
a) The volume or type of Waste differs materially from that described at the time of booking.
b) Access is significantly more difficult or time-consuming than reasonably anticipated.
c) Additional labour, equipment, or disposal arrangements are required.
6.5 Payment terms are as follows, unless otherwise agreed in writing:
a) For domestic customers, payment is due in full immediately upon completion of the Service and before our team leaves the Premises.
b) For business customers, payment is due in accordance with the agreed credit terms, usually within 14 or 30 days of the invoice date.
6.6 We accept common methods of payment such as cash, bank transfer, or card payments, subject to availability at the time of Service.
6.7 If you fail to pay any amount due under the Contract by the due date, we may charge interest on the overdue amount at the statutory rate and suspend further Services until payment is received.
7. Cancellations, Rescheduling, and Waiting Time
7.1 You may cancel or reschedule your booking by contacting us directly.
7.2 If you cancel more than 24 hours before the scheduled Service time, no cancellation fee will normally apply.
7.3 If you cancel less than 24 hours before the scheduled Service time, or if we attend the Premises and are unable to complete the Service due to reasons within your control, we may apply a cancellation or call-out charge to cover our costs.
7.4 If our team is required to wait at the Premises due to delays caused by you, we reserve the right to charge a reasonable waiting time fee, which will be detailed at the time of booking or on the day of Service.
7.5 We reserve the right to cancel or reschedule any booking due to operational issues, vehicle breakdowns, traffic conditions, staff availability, severe weather, or other events beyond our reasonable control. In such cases, we will offer an alternative date and time, and any pre-paid amounts for the affected Service will be applied to the rescheduled booking or refunded.
8. Customer Warranties
8.1 You warrant that:
a) You have full authority to request the removal of the Waste from the Premises.
b) The Waste presented for collection is your property or that you have obtained all necessary rights and consents to permit its removal.
c) The Waste does not include any prohibited or undisclosed hazardous materials.
8.2 You agree to indemnify us against any claims, losses, damages, or expenses arising from a breach of these warranties, including any third-party claims relating to ownership of the Waste or unlawful disposal caused by your misrepresentation.
9. Liability and Limits of Responsibility
9.1 We will take reasonable care when carrying out the Service at your Premises. However, we accept no liability for pre-existing damage or wear and tear to property, fixtures, fittings, or surfaces.
9.2 Minor scuffs or marks may occur where items are large, heavy, or awkward to remove through tight spaces. We will take reasonable steps to minimise such risk, but you accept that some cosmetic damage may be unavoidable in these circumstances.
9.3 To the fullest extent permitted by law, our total liability under or in connection with the Contract, whether in contract, tort, or otherwise, is limited to the total price paid or payable for the specific Service giving rise to the claim.
9.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law.
9.5 We are not liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the Service.
10. Insurance
10.1 We maintain public liability insurance and, where applicable, employer’s liability insurance to cover our operations in the waste collection sector.
10.2 Evidence of our insurance cover can be provided upon reasonable request.
11. Complaints
11.1 If you are dissatisfied with any aspect of the Service, you should contact us as soon as reasonably possible, providing full details of your concerns.
11.2 We will investigate your complaint and, where appropriate, may request photographs or further information. We aim to resolve complaints promptly and fairly.
11.3 Any claim relating to the condition of the Premises or the performance of the Service should be notified to us within a reasonable time and, in any event, no later than 7 days after the date of the Service.
12. Data Protection and Privacy
12.1 We collect and process personal information such as names, contact details, and addresses to manage bookings, provide the Service, and handle payments and invoicing.
12.2 We will handle your personal information in accordance with applicable UK data protection laws and use it only for legitimate business purposes related to the provision of our rubbish and waste collection services.
13. Force Majeure
13.1 We are not liable for any failure or delay in performing our obligations under the Contract where such failure or delay results from events, circumstances, or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, accidents, traffic disruption, strikes, fuel shortages, emergencies, or changes in law or regulation.
13.2 In such circumstances, we may suspend the Service for the duration of the event, or, where necessary, cancel the affected booking and offer an alternative arrangement where practicable.
14. Variation of Terms
14.1 We may amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements, or our business practices.
14.2 The version of the Terms and Conditions in force at the time of your booking will apply to that Contract. You should review the Terms and Conditions periodically to stay informed of any updates.
15. Severability
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract, or the provision of the Service.
By placing a booking for rubbish collection or waste removal, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
